By placing an order with Icandi Luscious Treats LLC, you acknowledge and agree to the policies and terms outlined below.
1. CUSTOM ORDER DISCLAIMER
All custom cakes, cookies, cupcakes, desserts, and other specialty orders are individually prepared and decorated.
Because our products are handmade, minor variations in color, size, texture, placement, decorations, and design may occur. These variations are a natural part of handcrafted products and do not constitute a defect.
Reference photos provided by customers are used for inspiration and guidance. We will make every reasonable effort to recreate the requested design; however, an exact replica cannot always be guaranteed.
Icandi Luscious Treats LLC reserves the right to make reasonable artistic adjustments when necessary to ensure the structural integrity, quality, and presentation of the finished product.
2. CAKE DESIGN & COLOR DISCLAIMER
Colors may appear differently depending on lighting, photography, screens, printers, and the type of edible materials used.
Exact color matching is not guaranteed.
Certain specialty colors, including but not limited to:
- Burgundy
- Navy
- Black
- Emerald
- Royal blue
- Dark purple
- Metallic gold
- Metallic silver
- Champagne
- Neon colors
may require additional preparation and/or specialty products.
Customers are responsible for communicating desired colors and design details clearly before the order is finalized.
Once a custom design has been approved, significant design changes may require an additional fee.
3. ALLERGEN & FOOD SAFETY DISCLAIMER
Icandi Luscious Treats LLC takes food allergies seriously.
Our products may contain or come into contact with common allergens, including but not limited to:
- Milk
- Eggs
- Wheat
- Soy
- Peanuts
- Tree nuts
- Coconut
- Other ingredients that may cause allergic reactions
Because ingredients may be prepared in an environment where multiple allergens are present, we cannot guarantee that any product is completely free from allergens or cross-contact.
Customers are responsible for informing us of any known allergies or dietary restrictions before placing an order.
If you have a severe or life-threatening food allergy, please contact us before ordering so we can determine whether we can safely accommodate your request.
We do not guarantee allergen-free products unless specifically confirmed in writing by Icandi Luscious Treats LLC.
4. DIETARY RESTRICTIONS
Please notify us of dietary restrictions before your order is accepted.
Requests involving gluten-free, dairy-free, nut-free, vegan, sugar-free, or other specialized dietary requirements may not always be available.
A product described as accommodating a dietary preference does not necessarily mean the product is produced in an allergen-free environment.
5. INGREDIENT SUBSTITUTIONS
Icandi Luscious Treats LLC reserves the right to make reasonable ingredient substitutions when necessary because of product availability, supplier shortages, seasonal ingredients, or other circumstances beyond our control.
Whenever a substitution would materially affect the requested product, we will make reasonable efforts to communicate with the customer.
6. DEPOSITS & PAYMENT
50% non-refundable deposit due at the time of booking to reserve the date.
The order is not confirmed until the deposit is received.
The deposit is non-refundable under all circumstances, including customer cancellation, because it covers your time, planning, and the reserved production slot
50% deposit of total due at booking balance is due 24 hours prior to event or total can be paid in full at booking, If booked 7 days or less total amount is due and may be subject to a rush fee.
A deposit or full payment may be required to reserve your order date.
All deposits are non-refundable unless otherwise required by applicable law or expressly approved by Icandi Luscious Treats LLC.
An order is not considered officially booked until the required payment has been received and the order has been confirmed.
Quotes, invoices, and conversations regarding availability do not guarantee an order date until payment and confirmation have been completed.
The remaining balance, when applicable, must be paid by the deadline stated on the customer’s invoice.
7. CANCELLATIONS
Custom orders involve advance purchasing of ingredients, supplies, packaging, decorations, and dedicated production time.
Cancellation policies may vary depending on how close the cancellation occurs to the scheduled production date.
Any eligible refund will be determined according to the terms provided on the customer’s invoice at the time of purchase.
Once production, preparation, or customization has begun, cancellation may result in the customer being responsible for the full order amount.
8. ORDER CHANGES
Changes to an order are not guaranteed once the order has been confirmed.
Changes involving:
- Flavor
- Size
- Quantity
- Colors
- Decorations
- Wording
- Delivery location
- Pickup date/time
- Design
may result in additional charges.
The ability to make a change depends on production schedules, ingredient availability, supply availability, and how close the order is to the scheduled fulfillment date.
9. PICKUP POLICY
Customers are responsible for picking up orders at the confirmed date and time.
Please arrive on time and bring an appropriate vehicle and/or transportation method for safely transporting your order.
Once the product has been picked up and leaves our possession, Icandi Luscious Treats LLC is not responsible for damage caused by:
- Improper handling
- Improper transportation
- Extreme temperatures
- Sudden stops
- Vehicle movement
- Failure to keep the product level
- Failure to follow provided handling instructions
Customers should transport cakes and other delicate desserts on a flat, stable surface in an appropriately climate-controlled vehicle.
Do not place cakes or delicate desserts on a car seat unless specifically instructed otherwise.
10. LATE PICKUP
Customers who arrive late for pickup may experience delays.
Depending on the circumstances, a late pickup fee may apply.
If an order is not picked up within the agreed-upon pickup window and the customer has not communicated with us, the order may be subject to cancellation or disposal without refund, to the extent permitted by applicable law.
11. DELIVERY POLICY
When delivery is purchased, the customer is responsible for providing an accurate delivery address, phone number, access instructions, and any other information necessary to complete delivery.
Delivery times may be affected by:
- Traffic
- Weather
- Road closures
- Accidents
- Construction
- Events
- Vehicle issues
- Other circumstances beyond our reasonable control
A delivery window is an estimated timeframe unless a specific guaranteed delivery time has been agreed to in writing.
Additional delivery fees may apply for changes to the delivery address after the order has been confirmed.
12. DELIVERY ACCEPTANCE
The customer or an authorized recipient should inspect the order upon delivery.
Any visible damage or significant issue should be reported immediately, preferably with photographs.
Once the order has been accepted, moved, stored, or handled by the customer or recipient, Icandi Luscious Treats LLC may not be responsible for damage resulting from subsequent handling or storage.
13. CAKE STORAGE & HANDLING
Customers are responsible for properly storing cakes and desserts after pickup or delivery.
Unless otherwise instructed, perishable desserts should be stored according to the storage instructions provided with the order.
Avoid leaving cakes or other perishable desserts in:
- Hot vehicles
- Direct sunlight
- Excessive heat
- Freezing temperatures
- Uncontrolled outdoor environments
Certain decorations may become affected by heat, humidity, refrigeration, or moisture.
Icandi Luscious Treats LLC is not responsible for damage resulting from improper storage or handling after the product has been delivered or picked up.
14. EDIBLE & NON-EDIBLE DECORATIONS
Some cakes and desserts may contain decorations that are not intended to be eaten, including but not limited to:
- Acrylic pieces
- Wooden toppers
- Wire
- Dowels
- Picks
- Toothpicks
- Decorative supports
- Non-edible glitter
- Certain decorative embellishments
Customers should inspect cakes and remove non-edible components before serving.
Parents and guardians should supervise children when cakes or desserts contain decorative elements or small pieces.
15. CAKE STRUCTURE & SUPPORT
Certain designs require internal supports, dowels, boards, separators, or other structural components.
These components are necessary to safely construct and transport certain specialty cakes.
Customers should not remove structural supports until the cake is ready to be served and the appropriate portions have been separated.
16. CUSTOMER-SUPPLIED ITEMS
If a customer supplies decorations, toppers, photographs, edible images, products, or other materials for use on an order, Icandi Luscious Treats LLC is not responsible for defects, damage, incompatibility, or poor quality caused by those customer-supplied items.
We reserve the right to decline the use of any item that may compromise food safety, structural integrity, or the quality of the finished product.
17. COPYRIGHTED & TRADEMARKED DESIGNS
Customers may request cakes, cookies, or desserts inspired by characters, brands, logos, sports teams, movies, shows, or other intellectual property.
The customer is responsible for ensuring that their requested use complies with applicable intellectual-property laws.
Icandi Luscious Treats LLC does not claim ownership of third-party characters, trademarks, logos, or copyrighted artwork.
We reserve the right to modify or decline a requested design when necessary.
18. PHOTOGRAPHY & MARKETING
Icandi Luscious Treats LLC may photograph completed products for portfolio, website, social media, advertising, or other business purposes.
If you do not want your specific order photographed or used for marketing purposes, please notify us in writing before the order is completed.
Customer names, personal information, and private event details will not knowingly be publicly disclosed without permission.
19. ORDER ERRORS
Customers are responsible for reviewing their order details before final approval.
Please carefully verify:
- Name
- Date
- Time
- Flavor
- Size
- Quantity
- Colors
- Cake wording
- Spelling
- Age
- Event details
- Delivery address
- Design specifications
Icandi Luscious Treats LLC is not responsible for errors that were approved by the customer or information that was incorrectly provided by the customer.
20. INSCRIPTION & SPELLING
Please carefully review all names, ages, dates, and wording before approving your order.
Once a custom product has been produced, changes may not be possible.
If an error is made because incorrect information was provided or approved by the customer, the customer may be responsible for the cost of correcting or recreating the product.
21. PRODUCT AVAILABILITY
All products, flavors, ingredients, decorations, and specialty items are subject to availability.
Icandi Luscious Treats LLC reserves the right to discontinue or modify products at any time.
22. FORCE MAJEURE
Icandi Luscious Treats LLC will make reasonable efforts to fulfill confirmed orders.
However, we are not responsible for delays, cancellations, or inability to fulfill an order caused by circumstances beyond our reasonable control, including but not limited to:
- Severe weather
- Natural disasters
- Power outages
- Fire
- Flooding
- Equipment failure
- Supplier shortages
- Transportation disruptions
- Government restrictions
- Public emergencies
- Acts of God
- Other unforeseen circumstances
If such an event occurs, we will make reasonable efforts to communicate with the customer and determine an appropriate resolution.
23. CUSTOMER RESPONSIBILITY
Customers are responsible for providing accurate information and following all pickup, delivery, storage, handling, and serving instructions.
By placing an order, the customer acknowledges that they have reviewed and agreed to these policies.
24. REFUNDS & REMAKES
Because our products are custom-made and often prepared specifically for individual customers, refunds are not automatically provided because of a change of mind, personal preference, or failure to follow handling instructions.
If you believe your order has a significant issue attributable to Icandi Luscious Treats LLC, please contact us as soon as possible with photographs and a description of the issue.
Each situation will be reviewed individually.
Any refund, credit, replacement, or other remedy will be determined based on the circumstances and applicable law.

27. WEBSITE & ORDER ACCEPTANCE

An order is considered accepted only after confirmation and receipt of any required payment.
We reserve the right to decline an order when necessary due to scheduling, capacity, product availability, safety concerns, or other legitimate business reasons.
